SALT BANKSIA TERMS & CONDITIONS / HIRE AGREEMENT

By accessing and using the Salt Banksia website, booking a garment, attending an appointment, or hiring from Salt Banksia, you accept & agree to be bound by these Terms & Conditions. Salt Banksia reserves the right to amend these Terms & Conditions at any time at its sole discretion.

DEFINITIONS

In these Terms & Conditions, “you” & “your” refer to all users of this website & customers hiring from Salt Banksia. “Salt Banksia”, “we”, “us” & “our” refers to Salt Banksia (ABN 82 930 228 628). These Terms apply to all bookings, hires, appointments, purchases & transactions made with Salt Banksia.

CONTRACT

These Terms & Conditions constitute a legally binding agreement between you & Salt Banksia. This agreement contains all terms relating to the hire or purchase of garments from Salt Banksia. By placing a booking, purchasing an item, attending an appointment, or collecting a garment, you agree that all transactions are subject to these Terms & Conditions. Nothing in these Terms excludes, restricts, or modifies any rights you may have under Australian Consumer Law.

PAYMENT TERMS

The hire fee includes the garment hire fee & any additional fees associated with your booking. By placing an order, you authorise Salt Banksia to charge your nominated payment method for hire fees, late fees, cleaning fees, damage fees, repair costs, replacement costs & loss-related charges.

Any invoice issued by Salt Banksia must be paid within seven (7) days of the invoice date unless otherwise stated. Failure to pay outstanding amounts may result in debt recovery action.

IDENTIFICATION

Identification is a mandatory requirement under Salt Banksia’s hiring policy. To hire a garment from Salt Banksia, customers must provide a valid form of identification.

Accepted identification may include a driver’s licence, passport, or other government-issued photo identification.

Salt Banksia reserves the right to request identification at any stage of the booking, collection, or hire process. Failure to provide valid identification may result in cancellation, refusal of hire, or refusal to release the garment.

TITLE TO HIRED GARMENTS

All hired garments remain the sole property of Salt Banksia at all times. Hiring a garment grants temporary use only for the agreed hire period, & ownership is never transferred.

Customers agree to treat all garments with exceptional care. Garments must not be forced if they do not fit, & customers must not misuse garments or damage zippers, closures, fabric, or embellishments.

No modifications or alterations may be made to any garment without prior written approval from Salt Banksia. This includes hemming, stitching, cutting, resizing, pinning, taping, or any permanent alteration. Unauthorised alterations may result in repair or replacement charges.

SALE ITEMS

All sale items are final sale. Sale items cannot be returned, exchanged, refunded, or credited unless required under Australian Consumer Law.

BOOKING PERIOD

The rental period begins on the agreed collection date & ends on the agreed return date. Garments must be collected & returned within the agreed hire period.

PICK-UP & RETURNS RESPONSIBILITY

Customers are solely responsible for collecting hired garments from Salt Banksia & returning them by the agreed return date & time.

Collection & returns must be made in-store at Salt Banksia, 8/54 Marina Boulevard, Larrakeyah NT.

It is the customer’s responsibility to ensure garments are collected with sufficient time before their event & returned on time to avoid late fees.

Failure to collect a garment does not entitle the customer to a refund, credit, or booking transfer unless required by Australian Consumer Law.

Garments must be returned by the agreed return date & time. Failure to return garments on time will incur late fees in accordance with these Terms & Conditions.

All responsibility & risk in the garment remains with the customer from the time of collection until the garment has been returned to & accepted by Salt Banksia.

GARMENT INSPECTION AT COLLECTION

All garments are carefully inspected by Salt Banksia prior to collection. At the time of collection, the customer is required to inspect the garment in-store with a Salt Banksia representative to confirm the garment is in acceptable condition before leaving the premises.

This includes checking for stains, marks, tears, faults, missing embellishments & general garment condition. By collecting the garment, the customer acknowledges they have inspected the garment & accepted its condition.

Customers may be required to sign confirmation that the garment has been inspected & accepted prior to leaving Salt Banksia.

If a customer identifies an issue after collection, Salt Banksia must be notified within 24 hours via email at admin@saltbanksia.com.au, including clear photographs. Salt Banksia will review the issue & determine whether the issue existed prior to collection or occurred during the hire period.

Minor wear consistent with normal rental use does not constitute damage or fault.

ISSUES WITH FIT OR APPEARANCE

Salt Banksia provides sizing information as accurately as possible. Customers are responsible for selecting the correct size.

Refunds or credits will not be provided if a garment does not fit, is unsuitable, or does not meet personal preference, unless required by law.

CANCELLATIONS

Bookings may be cancelled subject to the following conditions.

Cancellations made ten (10) days or more before the hire date are eligible for a full refund or store credit.

Cancellations made within ten (10) days of the hire date are eligible for store credit only, less any associated fees incurred by Salt Banksia.

Refunds will otherwise only be provided where required under Australian Consumer Law. All approved store credits are valid for twelve (12) months from the date of issue.

CLEANING

Professional cleaning is included in every hire. Under no circumstances are customers permitted to wash, dry clean, spot clean, iron, steam excessively, or attempt stain removal on any hired garment.

Customers must not attempt to clean garments themselves. If a customer attempts to clean a garment & damage occurs, additional charges may apply.

No refunds will be issued for minor creasing caused during wear.

DAMAGE OR LOSS

All garments are carefully inspected before & after each hire. Normal wear & tear is expected & included as part of the hire. This includes minor signs of wear consistent with careful use, including minor creasing, light wear to hems & general wear consistent with normal use.

Damage beyond normal wear & tear will incur additional charges. Damage includes, but is not limited to, stains, fake tan marks, makeup marks, tears or rips, broken zippers, pulled threads, missing buttons or embellishments, burn marks, water damage & permanent odours.

Failure to report pre-existing damage may result in the damage being deemed to have occurred during your hire period. Customers must not clean, repair, alter, hem, pin, tape, or otherwise modify a hired garment.

If Salt Banksia determines that a garment is damaged beyond normal wear & tear, the customer agrees to pay for professional cleaning, repairs, loss of rental income, partial replacement costs, or full replacement costs.

If a garment is lost, stolen, not returned, or deemed irreparably damaged, the customer agrees to pay the full retail value of the garment together with any associated costs incurred by Salt Banksia.

LATE RETURNS

Garments must be returned by the agreed return date & time. Late returns incur a fee of $30 per day.

Late fees continue until the garment is returned. Late returns that impact future bookings may incur additional charges, including compensation for loss of rental income where applicable.

TRY-ON APPOINTMENTS

Salt Banksia offers complimentary try-on appointments by booking only.

We kindly request a minimum of two (2) hours’ notice for appointment rescheduling or cancellations.

Repeated no-shows, missed appointments, or repeated late cancellations may result in future appointment restrictions.

Salt Banksia reserves the right to refuse future appointments at its discretion.

PHOTO CONSENT (OPTIONAL)

Customers may opt in to allow Salt Banksia to use submitted or tagged photographs & videos for promotional purposes, including use on the Salt Banksia website, social media & marketing materials.

Consent is optional & is not a condition of hire.

LIMITATION OF LIABILITY

Salt Banksia will not be liable for indirect or consequential loss arising from booking cancellations, fit issues, or event cancellations. This includes, but is not limited to, loss of opportunity, loss of income, emotional distress, or consequential losses.

Salt Banksia’s liability is limited to the amount paid by the customer to the extent permitted by law.

COLLECTION OF OUTSTANDING AMOUNTS

If payment remains outstanding, Salt Banksia reserves the right to pursue recovery of outstanding amounts through debt collection or legal proceedings. This may include recovery of associated costs where permitted by law.

Salt Banksia reserves the right to refuse future bookings at its sole discretion.
